By accessing or using CxLens (app.cxlens.io), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our service.

About CxLens

CxLens is a building commissioning management platform operated by CxLens LLC, a Georgia State LLC, that helps commissioning agents plan, manage, and track building commissioning processes.

User Accounts

Account Creation

• You must provide a valid email address to create an account
• You are responsible for maintaining the confidentiality of your account
• You must notify us immediately of any unauthorized use of your account
• One person per email address - accounts are not transferable

Access and Authentication

• We use one-time password (OTP) authentication sent to your email
• You are responsible for keeping your email account secure
• Access may be revoked at any time for violation of these Terms

Acceptable Use

You May

• Use CXLens for legitimate building commissioning activities
• Collaborate with team members within your organization
• Upload and manage project-related data
• Export your own data

You May Not

• Use the service for any illegal or unauthorized purpose
• Interfere with or disrupt the service or servers
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other users' data
• Share your account credentials with others
• Use the service to compete with or replicate our platform

Data and Content

Your Data

• You retain ownership of all data you upload to CxLens
• You grant us permission to store, process, and display your data to provide the service
• You are responsible for the accuracy and legality of the data you upload
• You must have the proper rights to any data you upload

Our Platform

• We retain all rights to the CxLens platform and technology
• You may not reverse engineer, copy, or create derivative works
• All improvements and modifications remain our property

Service Availability

• We strive for high availability, but cannot guarantee uninterrupted service
• We may perform maintenance that temporarily limits access
• We reserve the right to modify or discontinue features with reasonable notice

Privacy and Data Protection

• We implement security measures to protect your data
• We will not access your data except as necessary to provide the service or comply with the law

Limitation of Liability

CxLens is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service (if any)
• We are not responsible for data loss, though we make reasonable efforts to prevent it

Account Termination

You May

• Stop using the service at any time
• Request your account be deleted
• Request an export of your data before termination aka data deletion

We May

• Suspend or terminate accounts for Terms violations
• Discontinue the service with reasonable notice
• Remove inactive accounts after extended periods of non-use

Data Deletion

Modifications to Terms

• We may update these Terms from time to time
• Continued use after changes constitutes acceptance
• Material changes will be communicated via email or platform notice

Governing Law

These Terms are governed by the laws of the State of Georgia without regard to conflict of law principles.
