Owner's Project Requirements: Why You Need a Commissioning Agent Before You Write One

The Owner's Project Requirements (OPR) is the document that says what a building needs to do: what systems it needs, how reliable they need to be, how they should behave under failure, what the operating staff will be able to support. Everything downstream — design, construction, and every test a commissioning agent runs — is measured against it. Which is exactly why the timing of when you bring in a commissioning agent (CxA) matters more than most owners assume.

Ideally you should start talking to one as soon as possible, but realistically before the design is finished. The best time is pre-design or schematic design, and the latest you want to be is the end of design development.

The reason this article exists is that most owners hire later than that. The CxA usually shows up after the architect and engineers are already under contract, and often after the general contractor is too. The cost of that gap is real, but it does not show up as a line item. It shows up months later as rework, compressed schedules, and a punch list with items that could have been avoided.

Here is what a CxA actually does at each stage, so you can see what you get by hiring early and what you give up by waiting.

Pre-design: this is where the OPR gets written

A CxA at this stage helps write the OPR, sets the commissioning scope and budget, and defines what "done" means before anyone draws anything. Without one, the OPR is either thin, written by the design team to match what they already intend to design, or skipped altogether.

That last part is worth sitting with. An OPR written by the same team designing the building is checking their own work against their own intent. It's not malicious — it's just not what the document is for.

Schematic design and design development

This is the stage that matters most and the one that gets skipped most.

The CxA reviews the design against the OPR and looks for the things that are cheap to fix on paper and expensive to fix in the field: sequences of operations that do not match how the owner plans to run the building, equipment that cannot be tested the way the specs say it will be, control points that are missing, redundancy that looks fine on the single-line but breaks under a real failure scenario.

The evidence for this is not just anecdotal. Commissioning Agents Inc. (CAI) published a paper in 2019 called The Power of Design Review, written for the pharmaceutical commissioning and qualification world but built on a problem every industry shares. Their benchmarking found that most firms do not perform design review at all, and the ones that do tend to treat it as a checkbox for the validation team rather than a real engineering activity. The failures they trace back to that gap are familiar to anyone who has sat through a functional test: components sized wrong, instrument ranges that do not fit the process, mechanical and controls systems that do not integrate. All of it gets discovered during commissioning, and all of it costs more to fix there than it would have in design.

Construction documents

If the CxA is on board here, the commissioning specifications go into the bid set. Contractors price the real testing scope, the checklist requirements, and the documentation they will owe. When the CxA arrives after bid, all of that becomes a change order conversation, and the contractor is right to have it.

Construction

This is where most people picture commissioning happening, and it is where most of the hours go: submittal review, installation checklists, startup witnessing, functional performance testing, issue tracking and resolution. A CxA hired at this stage can still do all of it. What they cannot do is change the design they are testing, the specs the contractor bid, or the schedule that was built without a testing window in it.

Turnover and warranty

Integrated systems testing, operator training, the handover package, and the deferred testing that has to wait for the right season. A CxA who has been on the project since design knows what the OPR promised and can confirm the building delivers it. A CxA hired late is confirming the building matches the drawings, which is a smaller thing.

Why the design stage gets skipped

Two reasons, and they are both understandable.

The first is that the cost of skipping it is invisible when the decision gets made. Nobody sees the rework they avoided. The second is that a commissioning fee on a project that has not broken ground looks like an easy thing to defer. The design team is already reviewing the design, so why pay someone else to do it again?

The answer is that the design team is reviewing it against their own intent. The CxA is reviewing it against the owner's — against the OPR — and against whether it can actually be proven to work.

What if you are already in construction?

Most people searching this question are not at pre-design. If that is you, the honest answer is: hire now, and go in with clear eyes about what the CxA is inheriting.

They will inherit a design they did not review, specs the contractor bid without commissioning requirements, and a schedule that probably has testing as a single bar near the end. The most useful thing they can do in the first month is not start writing checklists. It is to get the commissioning workplan and the construction schedule in front of each other and find out where they disagree.

Late is still much better than never. But the things a CxA can fix late are the things that were going to be found in testing anyway. The things they could have fixed early — starting with the OPR itself — are the ones that never get found until the building is occupied.
